Terms and Conditions

1. Formation of the contract

1.1 These terms of sale apply to all goods supplied by Sounds Possible Limited trading as www.2to5.com or 2to5.co.uk and from herein after referred to as 2to5
1.2 No contract exists between you and 2to5 for the sale of any goods until 2to5 has received and accepted your order and sends you confirmation in writing or by email to the address or email address you have given. Once 2to5 does so, there is a binding legal contract between us.
1.3 The contract is subject to your right of cancellation (see clause 6 below).
1.4 2to5 may change these terms of sale without notice to you in relation to future sales.

 2. Description and price of the goods

2.1 The description and price of the goods you order will be as shown in the 2to5 current catalogue or on its website at the time you place your order.
2.2 The goods are subject to availability. If on receipt of your order the goods you have ordered are not available in stock, 2to5 will inform you as soon as possible, and give you the option of waiting for goods to arrive in stock, selecting an alternative or cancelling all or part of your order.
2.3 Every effort is made to ensure that prices shown in 2to5 current catalogue and on its website are accurate at the time you place your order. If an error is found, 2to5 will inform you as soon as possible and offer you the option of reconfirming your order at the correct price or cancelling your order. If you cancel, 2to5 will refund or credit you for any sum that has been paid by you or debited from your credit card for the goods.
2.4 No delivery charges will be added to any orders for delivery to mainland UK, however, there may be an additional surcharge for deliveries to the Isle of Man, Isle of Wight, Northern Ireland and the Scotish Islands and Highlands and the Channel Islands.
3. Payment

Payment for the goods can be made by any method shown on 2to5 website at the time you place your order. Unless you have an account with us all goods must be paid for in full prior to leaving our premises. If you have paid by PayPal and for any reason we are unable to deliver the goods in accordance with these terms and conditions you will be notified as soon as we are aware of a problem and given the option of leaving the order in place pending delivery from our suppliers or cancelling that part of the order which cannot be fullfilled. If you choose to cancel we will refund the value of the cancelled items through the PayPal refund process.

4. Delivery and returns
4.1 Deliveries made by courier or Royal Mail and may need to be signed for. If there is no one at the address given who is able to accept delivery of the goods, the carrier will place a card through your letterbox to inform you that they were unable to deliver your order. The carrier will endeavour to deliver your order on the next working day. For credit/debit card payments we will only deliver to the registered address of the credit card holder.
4.2 Every effort will be made to deliver the goods as soon as possible after your order has been accepted, and in any event within 30 days of your order. However, 2to5 will not be liable for any loss or damage suffered by you through any reasonable or unavoidable delay in delivery. In this case, 2to5 will inform you as soon as possible. 2to5 may, at its discretion, deliver the goods by separate installments. In this event no additional delivery charges will be incurred by you.
4.3 If you have paid by cash or credit card you will become the owner of the goods you ordered and responsible for risk of loss of or damage to them once they have been delivered to you. For account customers title in the goods shall not pass to you until full payment has been received by us but you are responsible for risk of loss of or damage to them once they have been delivered to you.
4.4 If the goods arrive by carrier and are obviously damaged you should sign the delivery note as damaged. 
4.5 In the unlikely event that you need to return goods to us you must first contact us to make arrangements for their return. 
4.6 If the goods are faulty you should repack them in all origianal packaging and notify 2to5 and make the goods available for collection. We will arrange collection at our cost and send out repalcement goods on confirmation that a fault existed with the original.
4.7 If you wish to return goods for any reason other than a fault, we are happy to accept these back subject to a mimimum collection charge of £6.50 + VAT. Higher charges may apply to delivery areas where an additional delivery cost has been charged. Alternatively you may return goods at your risk and cost.

5. Liability

5.1 Any damages and/or claims for defects and/or shortages must be notified to 2to5 via telephone or email as soon as possible and in any event no later than 48 Hours from the delivery date, otherwise 2to5.com cannot accept any liability. Further written confirmation of any claim must be received by 2to5.com within 10 days of the delivery date.
5.2 Once goods have been installed they cannot be returned unless faulty.
5.3 If you do not receive goods ordered by you within 30 days of the date on which you ordered them, 2to5 shall have no liability to you unless you notify them in writing of the problem within 40 days of the date on which you offered the goods.
5.4 If you notify a problem to 2to5 under this clause, their only obligation will be, at your option:
5.4.1 to make good any shortage or non-delivery;
5.4.2 to replace or repair any goods that are damaged or defective; or
5.4.3 to refund to you the amount paid by you for the goods in question.
5.5 Save as precluded by law, 2to5 will not be liable to you for any indirect or consequential loss, damage or expenses howsoever arising out of any problem you notify to us under this condition, and 2to5 shall have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question under clause 5.4.3 above.
6. Your right of cancellation

6.1 You have the right to cancel the contract with 2to5 at any time up to the end of seven working days after you receive the goods (see below). A working day is any day other than weekends and bank or other public holidays.
6.2 To exercise your right of cancellation, you must give written notice to 2to5 by hand or post, fax or email, at the address, fax number or email address shown below, giving details of the goods ordered and (where appropriate) their delivery.
6.3 If you exercise your right of cancellation after the goods have been delivered to you, you will be responsible for returning the goods to  2to5 at your own cost and risk. The goods must be returned to the address shown below. You must take reasonable care to ensure the goods are not damaged in the meantime or in transit. The goods must be returned to 2to5 in re-saleable condition with all original packaging.
6.4 If you cancel your contract but 2to5 has already processed the goods for delivery you must not unpack the goods when they are received by you and you must send the goods back to us at your own cost and risk as soon as possible.
6.5 Once you have notified 2to5 that you are cancelling the contract, 2to5will refund or credit you within 30 days from receipt of the returned goods. 2to5 will deduct the original cost of carriage plus a 10% restocking fee from the total sum that has been paid by you or debited from your credit card for the goods.
6.6 If you do not return the goods as required, 2to5 may charge you a sum not exceeding the direct costs of recovering the goods.

7. Data protection

7.1 2to5 will take all reasonable precautions to keep the details of your order and payment secure, but unless 2to5 is negligent, we will not be liable for unauthorised access to information supplied by you.
7.2 2to5.com will only use the information you provide about yourself for the purpose of fulfilling your order, unless you agree otherwise. 2to5 would like to notify you of products and offers that may be of interest to you from time to time, and if you would like to be notified of these, please tick the box below. You can correct any information about you, or ask for information about you to be deleted, by giving written notice to 2to5 at the address, fax number or email address shown below.

8. Applicable law

These terms of sale and the supply of the goods will be subject to English law, and the English courts will have jurisdiction in respect of any dispute arising from the contract.

9. Events beyond our control

2to5 shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond their reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.
10. Invalidity

If any part of these terms and conditions is unenforceable (including any provision in which 2to5 exclude their liability to you) the enforceability of any other part of these conditions will not be affected.

11. Entire agreement
These terms and conditions, together with 2to5 current catalogue and website prices, delivery details and contact details set out the whole of the agreement relating to the supply of the goods to you by 2to5  Nothing said by any sales person on 2to5 behalf should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any goods offered for sale by 2to5. Save for fraud or fraudulent misrepresentation, 2to5 shall have no liability for any such representation being untrue or misleading.

12. Third Party Rights
Except for our directors, employees or representatives, a person who is not a party to this agreement has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement but this does not affect any right or remedy of a third party that exists or is available apart from that Act
